Delhi High Court Rules Kendriya Vidyalaya Must Recognize EWS Certificates Nationwide

The Delhi High Court has ruled that the Kendriya Vidyalaya Sangathan (KVS) cannot deny admission to a student under the economically weaker section (EWS) category simply because the income certificate is from another state and not from the Delhi government. The court clarified that the Centre, which controls the KVS, is the appropriate authority for notifying the annual income threshold to determine EWS eligibility.

  • Annual Income Threshold: The central government, as the appropriate authority, has set the gross annual family income threshold for the EWS category at below Rs 8 lakh.
  • Income Certificate Validity: The court emphasized that for admission to any Kendriya Vidyalaya (KV) school across the country under the EWS category, the income certificate need not be issued by the state government where the school is located. It must be issued by an officer of the specified rank in the state where verification is possible.
  • Rejected Admission Case: The court’s ruling came in response to a petition where the KVS (Delhi region) rejected a student’s admission under the EWS category due to the certificate being issued in Uttar Pradesh and not by the Delhi government.
  • Relief Granted: The court allowed the petitioner’s plea, directing the KVS to grant regular admission to the student in Kendriya Vidyalaya, Narela, for the academic session 2023-2024 in Class 3.

Background

The petitioner, originally from Azamgarh, Uttar Pradesh, sought admission for his son in Class 1 under the EWS category. Despite significant delays due to litigation, the court ordered the admission to Class 3.

The ruling ensures that EWS certificates issued by the specified authorities in any state are valid for admission to Kendriya Vidyalayas across the country.
