The Central Board of Secondary Education (CBSE) has opposed a Public Interest Litigation (PIL) seeking a uniform education system with a common syllabus and curriculum in the mother language up to Standard 12. CBSE argues that education falls under the Concurrent List of the Constitution, and it’s the responsibility of State/Union Territory Governments to frame syllabus and conduct exams. They emphasize the National Curriculum Framework (NCF) as a guideline and state that local context, culture, and language must be considered.

CBSE requests the High Court to dismiss the PIL, asserting that a uniform board and syllabus overlooks the importance of local context, culture, and language. They advocate for flexibility to incorporate regional resources, culture, and ethos, as it helps students relate to their curriculum better.
PIL Background
The PIL raised concerns about the disparity between entrance examinations syllabus, such as JEE, NEET, and various boards like CBSE, ICSE, and State Boards. It argued that this disparity hampers equal opportunities for students, violating Articles 14-16.
Uniform Education’s Importance
The petitioner, Ashwini Kumar Upadhyay, stresses the need for a standardized education system up to Standard 12. He argues that the current system divides society and discriminates based on socioeconomic conditions. Standardization, he says, would bridge the gap between government and private school students, providing equal chances for college and university admission.
